Terms & Conditions

Effective Date: March 18, 2019

These Terms and Conditions ("Agreement") constitute a legally binding contract between you ("Subscriber," "you," or "your") and ID Approach ("Company," "we," "our," or "us"). By subscribing to or using any of our services and/or subscriptions you agree to comply with and be bound by the terms set forth herein.​​​​

1. Definitions

  • "Services": The identity theft protection, monitoring, and spam call elimination/mitigation services provided by ID Approach, including but not limited to identity theft monitoring, spam call and telemarketing elimination, and root cause remediation.

  • "Subscription Plans": The service tiers offered by ID Approach, specifically Silver, Silver Plus, and Gold, each with varying levels of service and associated fees.

  • "Term": The duration for which the Subscriber has access to the Services, specifically a term of 10 years from the date of activation.

  • "Subscriber": An individual who has purchased and activated a Subscription Plan with ID Approach.​​

2. Services Provided

ID Approach offers a comprehensive variety of services designed to protect and monitor your personal information:

  • Identity Theft Monitoring: Continuous surveillance of personal data to detect unauthorized use.

  • Spam Call and Telemarketing Elimination: Identification and blocking of unwanted communications.

  • Root Cause Remediation: Addressing underlying issues contributing to identity vulnerabilities.

  • Advanced Threat Identification: Utilizing sophisticated internally developed algorithms and methods to detect and trace the origins of malicious activities.

  • Aggressive Countermeasures: Implementing strategic actions to neutralize identified threats.

  • Continuous Adaptation and Improvement: Regular updates and refinements to stay ahead of emerging threats. Our development team engineers its own software exclusive only to us protected by US law. Please refer to other legal agreements enclosed within.   

The specific features and services available to you depend on the Subscription Plan you select.​

3. Subscription Plans and Term

  • Silver Plan: Provides essential identity protection services.

  • Silver Plus Plan: Provides essential identity protection services with additional personnel.

  • Gold Plan: Delivers comprehensive protection with premium services including but not limited to spam call and telemarketing elimination.

Each Subscription Plan is valid for a term of 10 years from the date of activation. Subscriptions will not automatically renew at the end of each term unless renewed by the Subscriber.​​

4. Fees and Payment

  • Subscription Fees: The fees for each Subscription Plan are outlined at the time of subscription and are subject to change upon renewal.

  • Payment Terms: Payment is due at the time of subscription activation.

  • Refund Policy: Refunds are not provided after the commencement of services under all plans. However, a six month period from the time of a plan purchase will be available for a cancellation and refund request of up to 50% of the plan purchase price. This has been established for the sake of, and may be issued in the event a subscriber is dissatisfied or otherwise submits a request for a partial refund to our billing department. The refund of up to 50% shall be issued as soon as the request from the subscriber has been received and properly assessed, and without delay.​​

5. Subscriber Obligations

  • Accurate Information: Provide truthful and accurate personal information during the subscription process. Subscriber shall not hold us accountable for any information provided to us that has any trace of falseness or incorrectness to any extent, regardless of the piece of information being provided to us for the sake of the services provided from us to the subscriber.

  • Compliance: Adhere to all applicable laws and regulations while using our services.

  • Notification: Promptly inform ID Approach of any suspected identity theft or unauthorized activity.

  • Cooperation: Fully cooperate with ID Approach in the investigation and remediation of any identity theft incidents.​​

6. Company Obligations

  • Service Provision: Deliver services as described in the selected Subscription Plan.

  • Confidentiality: Maintain the confidentiality of Subscriber information in accordance with our Privacy Policy.

  • Limitation of Liability: While we strive to provide effective protection, ID Approach does not guarantee the prevention of all identity theft incidents and/or elimination of all incoming spam & telemarketing communications attempted by individuals, companies or other entities. â€‹â€‹â€‹â€‹

7. Termination

  • By Subscriber: Subscribers may cancel their subscription at any time; however, no refunds will be issued besides what has been established and outlined within our refund policy. To cancel a subscription, a subscriber must contact us and submit a request to do so, and so shall be done without delay whatsoever. A notification shall be provided from us upon a successful cancellation of a subscription.

  • By Company: ID Approach reserves the right to terminate services if the Subscriber violates any terms of this Agreement.​​

8. Limitation of Liability

ID Approach's liability is limited to the amount paid by the Subscriber for the services rendered. We are not liable for indirect, incidental, or consequential damages arising from the use or inability to use our services. we are committed to providing our subscribers with effective identity theft monitoring and mitigation services. However, it is essential to understand the scope and limitations of our services to set realistic expectations. Our services are designed to monitor and alert you to potential risks related to identity theft, unauthorized account activity, and other related threats. We utilize advanced tools and methodologies to detect suspicious activities, such as unauthorized credit inquiries, changes in personal information, and the presence of your data on the dark web. Additionally, we offer strategies to mitigate these risks and guide you through steps to protect your personal information. While we strive to provide comprehensive monitoring and risk mitigation, it is crucial to note that: we do not prevent identity theft, account hijacking, or fraud; our services are preventive in nature, aiming to alert you to potential threats. We cannot stop fraudulent activities from occurring. We do not eliminate spam calls or telemarketing outreach: While we may offer an array of internally developed and advanced technology tools to help manage unwanted communications, we cannot guarantee the complete elimination of such calls. We do not guarantee the prevention of data breaches or unauthorized data trading: Our monitoring can detect when your information may be compromised, but we cannot prevent breaches or control how your data is used by third parties. We do not guarantee satisfaction: While we aim to provide valuable services, we cannot guarantee that our services will meet every individual's expectations or needs.​​

9. Indemnification

By subscribing to and utilizing the services provided by ID Approach, you, the Subscriber, agree to indemnify, defend, and hold harmless ID Approach, its affiliates, subsidiaries, officers, directors, employees, agents, and assigns (collectively referred to as the "Indemnified Parties") from and against any and all claims, demands, actions, suits, damages, liabilities, losses, costs, expenses, or other obligations, including but not limited to reasonable attorneys' fees and court costs, arising out of or related to your use of our services. â€‹This indemnification obligation applies regardless of whether the claim arises from your own actions, omissions, or negligence, and extends to any third-party claims that may be brought against the Indemnified Parties as a result of your use of the services provided by ID Approach. You agree to promptly notify ID Approach of any claim or legal proceeding for which indemnification is sought, and to cooperate fully in the defense of such claims. ID Approach reserves the right to assume the exclusive defense and control of any matter subject to indemnification, at its own expense, and you shall not settle any such matter without the prior written consent of ID Approach. This indemnification provision shall survive the termination or expiration of your subscription and shall remain in full force and effect.

By accepting these terms, you acknowledge and agree to the terms of this indemnification and hold harmless agreement.​

10. Amendments

ID Approach reserves the right to modify, amend, or update this Agreement at any time, without prior notice, to reflect changes in our services, legal requirements, or business practices. Such modifications may include, but are not limited to, alterations in service offerings, pricing structures, or terms of use. Subscribers will be notified of significant changes to this Agreement through reasonable means, which may include email notifications, website announcements, or other communication methods deemed appropriate by ID Approach. These notifications will provide details of the changes and, where applicable, instructions on how to review and accept the updated terms. Continued use of ID Approach's services after the effective date of any modifications constitutes acceptance of the revised terms. If a Subscriber does not agree to the updated terms, they must discontinue use of the services and may terminate their subscription in accordance with the termination provisions outlined in this Agreement. It is the responsibility of the Subscriber to regularly review this Agreement to stay informed of any changes. ID Approach encourages Subscribers to check for updates periodically to ensure they are aware of the most current terms governing the use of our services. In the event of a dispute regarding the applicability or enforceability of any modified terms, the Subscriber acknowledges that their continued use of the services after notification of such changes will be considered as consent to the revised Agreement.​​​

11. Dispute Resolution

Any disputes arising under this Agreement will be resolved through binding arbitration in the jurisdiction where ID Approach choses with exclusiveness.​​

13. Privacy Policy

The collection and use of personal information are governed by our Privacy Policy, which is incorporated herein by reference.​​
